Article 28 of the Act gives four rights to exercise, known as “ARCO Rights”:

You must include in your request: Name (s) and surname (s), a clear and precise description of the personal data you seek to exercise any of the above rights, attach a copy of your ID or on electronic media digitized thereof (scanning) version as well as to provide an address for reporting purposes related to the case.
Upon reception, the Company will have a period of 20 working days to respond to your request, but this deadline may be extended for an equal period of time, which will be notified to you, by the same means you have indicated for that purpose, stating the reasons for such extension, in accordance with Article 32 of the Law.
We also inform you that in terms of the Act and its Regulations, you can start the procedure of Protection of ARCO Rights, with the National Institute for Transparency, Access to Information and Protection of Personal Data (hereinafter the “INAI”), within 15 days following the date in which the Company gives a response to your request and it is not satisfactory to you, or if once the period specified has passed, the Company has not answered to your request.
You have the right at all times to revoke the consent given to us for the treatment of your personal data, in order to abstain from using them, as long as they are not necessary for the fulfillment of obligations for services hired. For the aforementioned revocation, you should follow the same procedure for the exercise of the Arco Rights described above.
We clarify that it is the Federal Institute of Access to Information and Protection of Personal Data who is entrusted to ensure your ARCO Rights and responsible for regulating and monitoring the compliance with the Act.
The Company reserves the right to make, at any time, changes and updates to this Privacy Notice.

Si usted está accediendo a nuestro sitio web desde un lugar ubicado fuera del territorio mexicano, tome en cuenta que la información que nos proporcione será almacenada y procesada en México, lugar donde opera nuestra base de datos principal, por lo que será protegida de conformidad con las leyes mexicanas aplicables en materia de protección de datos personales.

II. Con las autoridades, tribunales y agencias gubernamentales reguladoras para cumplir con las órdenes judiciales, los requisitos legales o reglamentarios, y las peticiones del Gobierno.

En cualquier caso, su solicitud podrá ser enviada por correo electrónico al departamento de Administración de Datos Personales a la siguiente dirección: admon@www.beyond-experience.com, o bien físicamente por correo convencional a las oficinas de la EMPRESA, ubicadas en: Blvd. Luis Donaldo Colosio, Manzana 1, Lote 3, Edificio Tulum Trade Center, Piso 4, SM.9 Local 405 y 407, Cancún, Quintana Roo, C.P. 77503, en días hábiles, en un horario de 9:00 horas a 18:00 horas.
Deberá incluir en su solicitud: Nombre (s) y Apellido (s), una descripción clara y precisa de los datos personales respecto de los que se busca ejercer alguno de los derechos antes mencionados, adjuntar copia simple de su identificación oficial o en medios electrónicos versión digitalizada de la misma (escaneo), así como proporcionar la dirección para fines de notificación relacionadas al caso.
A partir de la recepción, la EMPRESA contará con un plazo de 20 días hábiles para responder a su solicitud, sin embargo dicho plazo podrá ser ampliado por un periodo de tiempo igual, lo que le será notificado, por el medio que usted nos haya indicado para tales efectos, señalando las razones de dicha ampliación, de conformidad con el artículo 32 de la Ley.
Asimismo, le informamos que en términos de la Ley y su Reglamento, usted puede iniciar el procedimiento de Protección de Derechos ARCO, ante el Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (en lo sucesivo el “INAI”), dentro de los 15 días siguientes a la fecha en que la EMPRESA de respuesta a su solicitud y esta no le sea satisfactoria, o bien, si transcurrido el término señalado, la EMPRESA no diera respuesta a su solicitud
Usted tiene derecho en todo tiempo, de revocar el consentimiento que nos ha otorgado para el tratamiento de sus datos personales con el propósito que se deje de hacer uso de los mismos, siempre y cuando no sean necesarios para el cumplimiento de las obligaciones por los servicios contratados. Para la revocación antes mencionada, usted deberá seguir el mismo Procedimiento para el ejercicio de los Derechos ARCO antes descrito.
Le hacemos patente que es el Instituto Federal de Acceso a la Información y Protección de Datos Personales quien tiene encomendado velar por sus derechos ARCO y el encargado de regular y verificar la observancia de la Ley.
La EMPRESA se reserva el derecho de efectuar, en cualquier tiempo, modificaciones o actualizaciones al presente Aviso de Privacidad.
Las modificaciones o actualizaciones que se efectúen, se pondrán a disposición del público a través nuestro sitio web y entrarán en vigor a partir del momento en que sean publicadas en el mismo, en sus sitios afiliados o en cualquier medio de comunicación que utilice para publicarlo, por lo que se recomienda su revisión continua.

El término “AFILIADO” se refiere a toda persona física que cuenta con una licencia de uso y acceso al SITIO WEB y que hace una reservación a través del SITIO WEB.

q).- USO DEL SITIO.- Para la consulta y uso del SITIO WEB, el AFILIADO garantiza; (i) Tener capacidad jurídica para contratar. ii) Tener por lo menos 18 (dieciocho) años de edad. iii) Utilizar para su uso personal el SITIO WEB y exclusivamente para reservaciones, por lo cual no podrá comercializar o reservar para terceros a cambio de remuneración alguna. iv) Leer y aceptar los Términos y Condiciones, así como revisar previamente al proceso de reservación, los detalles y precios. v) El SITIO WEB de BEYOND contiene material protegido por derechos de autor, marcas registradas y otros derechos comerciales, incluyendo sin limitación alguna, textos, software, fotografías, videos, gráficos, música y sonidos, por lo cual, el AFILIADO será el único responsable por cualquier daño que se cause por cualquier violación a los Derechos de Autor, de Propiedad Industrial, o a cualquier otra clase de Propiedad de Derechos, o por cualquier otro daño que se ocasione por el mal uso que AFILIADO haga del SITIO WEB. vi) El Afiliado no deberá insertar “Upload”, presentar o de cualquier otra forma hacer que esté disponible en el SITIO WEB ningún material protegido por derechos de autor, marca comercial u otro derecho de propiedad sin el consentimiento expreso del propietario de los derechos de autor, marca comercial u otro derecho de propiedad, vii) BEYOND se reserva el derecho a su entera discreción de negar el acceso al SITIO WEB a cualquier persona, en cualquier momento y por cualquier razón, incluso pero sin limitarse, a la violación de los Términos y Condiciones de uso, vii) queda prohibido que el AFILIADO realice o efectúe una reservación fraudulenta, falsa o especulativa o cualquier reservación en anticipación a una demanda. ix) El AFILIADO no podrá en ningún momento y bajo ningún concepto copiar, reproducir, volver a publicar, cargar, modificar, transmitir, distribuir contenido, encuadrar, crear un sitio espejo, copiar en todo o en parte, o de cualquier otra manera incorporar cualquier parte del SITIO WEB en otro sitio de internet, descargar o copiar en ningún dispositivo electrónico, de igual forma no podrá copiar, reproducir en forma impresa, digital, escrita, gráfica o de cualquier forma, sin autorización expresa por escrito de BEYOND. x) BEYOND podrá en cualquier momento y sin previo aviso, si detecta que la reservación del Afiliado muestra señales de fraude, abuso o actividades sospechosas, cancelar cualquier reservación relacionada con su nombre, dirección de correo electrónico o cuenta y cerrar cualquier cuenta asociada. BEYOND se reserva el derecho de presentar en contra del AFILIADO cualquier acción legal por sospecha de fraudes. xi) El AFILIADO no podrá violar las restricciones automatizadas de los encabezados de este SITIO WEB, o bien, realizar cualquier acción que viole o supere las medidas de seguridad utilizadas para prevenir o limitar el acceso al SITIO WEB. xii) EL AFILIADO no podrá realizar acciones que puedan ser consideradas como descarga o copia de la infraestructura de BEYOND.
BEYOND podrá revisar frecuentemente y sin previo aviso el perfil del AFILIADO y cualquier información que se transmita o reproduzca en este SITIO WEB, reservándose el derecho de censurar, eliminar, modificar o prohibir total o parcialmente la transmisión que a opinión de BEYOND viole las condiciones, seguridad, imagen o cualquier otra contraria a sus políticas.
El AFILIADO declara por su propio y personal derecho, i) ser una persona física, ii) contar con la capacidad legal y jurídica, iii) contar con capacidad económica para contratar y sujetarse a los presentes Términos y Condiciones, iv) así como tener el interés propio, personal y voluntario de realizar búsquedas y adquirir reservaciones a través del SITIO WEB, v) manifiesta de la misma manera reconocer a BEYOND como intermediario y entender y aceptar que los PROVEEDORES y PRESTADORES cuentan con sus propios términos de contratación por servicio o producto.
LA MEJOR Y MAS GRANDE EXPERIENCIA, S. de R.L. de C.V. declara, i) ser una persona Moral debidamente constituida de acuerdo a la legislación mexicana, ii) tener como Registro Federal de Contribuyentes MMG140121UR7, iii) tener como domicilio para todo tipo de notificaciones derivado del presente, el ubicado, sito en Blvd. Luis Donaldo Colosio, Manzana 1, Lote 3, Edificio Tulum Trade Center, Piso 4, SM.9 Local 405 y 407, Cancún, Quintana Roo, C.P. 77503, iv) ser una agencia de viajes y tener dentro de su objeto social en carácter de intermediario, la comercialización y promoción de todo tipo de servicios y productos turísticos o recreativos.
El AFILIADO y BEYOND declaran, i) entender y aceptar que para los efectos de búsqueda y reservaciones a través del SITIO WEB se sujetarán a los presente Términos y Condiciones.
EL AFILIADO podrá realizar búsquedas y reservaciones de los productos y servicios que BEYOND promociona y comercializa en carácter de intermediario a través de su SITIO WEB.
BEYOND otorgará previamente al AFILIADO una licencia de uso del motor de búsqueda y reservaciones del SITIO WEB, de acuerdo a las políticas y condiciones sujetas para dicha licencia
Cada producto y servicio dentro del SITIO WEB contendrá los precios mismos que serán válidos únicamente durante la cotización y hasta que una misma reservación ha sido completada. Las reservaciones estarán sujetas a disponibilidad y a las políticas y condiciones de los PROVEEDORES y PRESTADORES; los precios o costos podrán variar según la temporada del año, país, o factores varios, los cambios y modificaciones a las reservaciones podrán estar sujetas a disponibilidad y cambios de tarifa.
Una vez confirmada la reservación, el AFILIADO deberá imprimir su confirmación y presentarla en las fechas señaladas a los PROVEEDORES o PRESTADORES para hacer valido el servicio.
BEYOND se reserva el derecho de adicionar o modificar los Términos y Condiciones en cualquier momento sin previa notificación al AFILIADO. Los términos y condiciones, así como sus modificaciones se considerarán su entrada en vigencia a partir del momento en que son publicados. El Afiliado podrá en todo momento revisar los Términos y Condiciones mediante el sitio web www.www.beyond-experience.com
El AFILIADO reconoce que BEYOND es una empresa cuyo objeto es la prestación de servicios en carácter de Intermediación de Agencia de Viaje a través de Internet. BEYOND efectúa bajo su requisición, las reservaciones de los productos y servicios promocionados a través del SITIO WEB, entre AFILIADO y el PROVEEDOR o PRESTADOR. Derivado de lo anterior, BEYOND no tiene, asume, tendrá o asumirá responsabilidad alguna generada de la relación entre el AFILIADO y el PROVEEDOR o PRESTADOR final de los productos y servicios. Por lo cual, el AFILIADO al momento de reservar y comprar acepta y reconoce lo estipulado en estos términos y condiciones y libera a BEYOND de cualquier responsabilidad por: i) fallas, ii) demoras, iii) incumplimiento parcial, iv) incumplimiento total, v) cargos sobre los productos y/o servicios que sean proporcionados de manera directa por uno o varios PROVEEDORES o PRESTADORES y no de manera directa por BEYOND.
El AFILIADO podrá en todo tiempo de manera directa o a través de otros intermediarios, adquirir productos iguales, similares, análogos o cualquier otro producto o servicio diferente del mismo PROVEEDOR o PRESTADOR, por lo cual, BEYOND no será responsable por los PRODUCTOS y SERVICIOS adquiridos directamente o a través de intermediarios a los PROVEEDORES o PRESTADORES de BEYOND.
BEYOND no se obliga ni garantiza a publicar en todo momento las mejores tarifas, sin embargo, BEYOND buscará siempre las alianzas comerciales que brinden beneficios, descuentos, paquetes, o cualquier beneficio adicional al AFILIADO.
Todos los PROVEEDORES y PRESTADORES de BEYOND se reservan el derecho de cambiar en cualquier momento las tarifas y costos, por lo que BEYOND se reserva el derecho de cancelar cualquier reservación si el pago completo no ha sido efectuado por parte del AFILIADO.
BEYOND no será responsable por los cargos o adquisiciones extras que el AFILIADO adquiera directamente de los PROVEEDORES o PRESTADORES.
Los PROVEEDORES o PRESTADORES podrán solicitar al AFILIADO una liberación de responsabilidad para realizar o ejecutar algún servicio.
El AFILIADO deberá leer las características y políticas de cancelación del producto que adquiere a través del SITIO WEB. El AFILIADO manifiesta conocer y entender que las reservaciones y compras que efectúa a través del SITIO WEB se encuentran sujetos a términos y condiciones adicionales, por lo que se le pide y recomienda leer cuidadosamente esos Términos y Condiciones, mismos que han sido determinados por parte de los PROVEEDORES y PRESTADORES. El AFILIADO otorga sujetarse de los términos y condiciones adicionales, al realizar, efectuar y aplicar la reservación y/o compra de los PRODUCTOS o SERVICIOS, aceptando de manera enunciativa más no limitativa pagar oportunamente cualquier adeudo, adquisición extra, así como cumplir con las políticas y reglamentos establecidos por los PROVEEDORES y PRESTADORES en relación a la aplicación de la reserva, disponibilidad, fechas, y productos o servicios contratados.
Un vuelo queda confirmado única y exclusivamente cuando el pago ha sido cargado y el AFILIADO recibe en el momento a través del SITIO WEB o por correo electrónico, los billetes de confirmación de la reservación aérea.
El AFILIADO queda obligado al utilizar servicios de transportación aérea, a contar con pasaporte vigente, impresión de la confirmación que del vuelo se emita, visa (en caso de aplicar), revisar las políticas de seguridad, además de cualquier otro documento que la aerolínea tenga estipulada en el momento de la prestación del servicio.
Por políticas de PROVEEDORES y PRESTADORES podrá darse el caso que al momento de hacer efectivo el producto o servicio, el PROVEEDOR o PRESTADOR solicite al AFILIADO dejar una tarjeta de crédito o garantice en efectivo los posibles gastos extras. Dichos depósitos y cargos serán ajenos completamente a BEYOND.
BEYOND promociona y reserva a través del SITIO WEB en carácter de agencia de viajes como intermediario a destinos en el extranjero especificados en el SITIO WEB, BEYOND no aconseja viajar a ningún destino en particular, por lo cual no garantiza ni garantizará que el viaje a dichos destinos internacionales sean seguros o libres de riesgos y NO será responsable por daños o pérdidas derivados del viaje a los mismos.
El AFILIADO entiende que la violación de cualquiera de las reglas o restricciones anteriores, pueden tener como consecuencia por parte de BEYOND y/o PROVEEDOR y/o PRESTADOR la cancelación de su reservación, que se le niegue el acceso a los productos o servicios contratados sin derecho a reembolso.
EL AFILIADO es y será en todo momento, el único responsable de garantizar que cumple con los requisitos legales para la salida de su país, así como de entrada a países extranjeros, por lo tanto, el AFILIADO deberá investigar por cuenta propia la legislación vigente del país de origen y del de destino del viaje y tramitar por cuenta personal los documentos necesarios como pasaportes, visas, permisos notariales en caso de que los menores viajen sin uno o ambos padres, y en general cualquier legislación vigente en el país de origen y de destino.
BEYOND intenta en todo momento, brindar al AFILIADO, los precios y tarifas más exactos; sin embargo, estos precios y tarifas no están garantizados y pueden variar y sufrir cambios de último minuto que BEYOND no puede controlar.
BEYOND no será responsable bajo ninguna circunstancia por daños, lesiones, pérdidas, perjuicio o ilícito que resulte del uso de este SITIO WEB o del contenido que aquí se encuentre, por la falla, demora o imposibilidad de usar cualquier componente de este SITIO WEB para los servicios de reservación y compra.
Ni BEYOND, ni sus socios comerciales, serán responsables por cualquier daño directo o indirecto, punitivo, incidental, compensatorio, consecuencial que se puedan provocar al dispositivo electrónico del AFILIADO resultado de virus por sus SITIO WEB, servidores, correos electrónicos o debido al acceso, uso o navegación que haga de este sitio, o por la descarga de cualquier material, dato, texto, imagen, video o audio dese el SITIO WEB. Los correos y servidores de BEYOND se mantienen protegidos constantemente de virus cibernéticos.
La información, contenido y descripción, software, productos y servicios que se publiquen en este SITIO WEB pueden contener errores o inexactitudes, incluyendo errores de precios. BEYOND no garantiza con exactitud y no asume responsabilidad alguna por las inexactitudes o errores relacionados con la información, descripción de los productos y servicios proporcionados por los PROVEEDORES y PRESTADORES.
BEYOND no será responsable por mal clima en las fechas que la reserva del AFILIADO sea aplicable. El AFILIADO no podrá solicitar reembolso a BEYOND bajo esta causal.
BEYOND se reserva el derecho de corrección de precios y contenido dentro del SITIO WEB o directamente en las reservaciones efectuadas que hayan sido realizadas con precios inexactos, pudiendo en todo momento BEYOND solicitar el pago correcto o cancelar sin penalización la reservación del AFILIADO.
La calificación de productos hoteles promocionados dentro del SITIO Web, tienen la finalidad de proporcionar un parámetro general al AFILIADO de las condiciones, características y calidad en el servicio. BEYOND no garantiza i) la exactitud de la calificación de los productos hoteles, ii) productos o servicios que se puedan encontrar alrededor del producto Hotel seleccionado, iii) ciertos productos o servicios que se deseen conseguir dentro del producto Hotel seleccionado.
BEYOND no tiene ni tendrá ningún tipo de relación laboral con los PROVEEDORES y PRESTADORES o con terceros contratados por los mismos, por lo que BEYOND no será responsable por los actos u omisiones en que incurran dichos PROVEEDORES y PRESTADORES o los terceros que tengan contratados para otorgar el producto o prestar el servicio.
BEYOND no será responsable y no proporcionará reembolso alguno con motivo de demoras, cancelaciones, sobrecupo, huelga, caso fortuito, fuerza mayor o cualquier otra causa fuera de su control directo, así como tampoco tiene o tendrá responsabilidad alguna relacionada con cualquier gasto adicional, omisión, demora, cambios de ruta o actos de cualquier autoridad o gobierno, así como de las disposiciones legales o sus modificaciones en los países donde se otorga el producto o se presta el servicio.
En caso fortuito o de fuerza mayo, BEYOND podrá suspender la prestación de sus servicios hasta que el evento que origine la causa haya pasado y cedido por completo. BEYOND garantizará única y exclusivamente los productos y servicios que el AFILIADO haya reservado, comprado y totalmente pagado hasta antes que se origine el evento de caso fortuito o de fuerza mayor.
BEYOND podrá ceder o delegar en parte o en todo derechos y obligaciones de este contrato sin previo aviso o sin necesidad de consentimiento por parte del AFILIADO. BEYOND se obliga y compromete a garantizar la prestación de los servicios de intermediación en caso de cesión o delego en parte o del todo de sus obligaciones.
El AFILIADO no podrá ceder, subcontratar, delegar derechos u obligaciones aquí contraídas. El AFILIADO no podrá bajo ningún concepto comercializar o utilizar este SITIO WEB con fines comerciales o de lucro.
Todas las cancelaciones deberán seguir el siguiente proceso: i) El AFILIADO deberá llamar a BEYOND manifestando su deseo de cancelar el servicio previamente contratado, BEYOND asignará un asesor de viajes y el correo electrónico, ii) El AFILIADO deberá enviar un correo electrónico al asesor de viajes asignado por BEYOND especificando la fecha de compra y la clave de reservación o confirmación.
El AFILIADO podrá cancelar o cambiar su reservación de hotel de la cual previamente se haya efectuado el pago de la totalidad de la reserva. BEYOND no se responsabiliza por ningún cambio de itinerario, o por cualquier cambio o error en datos proporcionados por AFILIADO para la reservación de hospedaje como puede ser el caso de nombres, apellidos, edades, sexo, fechas, rutas, líneas aéreas, clases, categorías, o cualquier otro proporcionado por el AFILIADO.
Cada cancelación o cambio estará sujeta a las políticas de cancelación y cambios del Hotel reservado. Si el AFILIADO NO cancela o cambia su reservación antes del período aplicable en la política de cancelación del hotel que reservó, lo cual varía en cada hotel, será sujeto a un cargo igual a la tarifa por noche aplicable, los cargos por recuperación de impuestos y cuotas por servicios. En el caso de que no se presente la primera noche de la reservación y planea registrarse para las noches siguientes en su reservación, debe confirmar los cambios de reservación con el Concierge de Viajes antes de la fecha de la reservación de la primera noche para evitar la cancelación de su reservación.
El AFILIADO acepta pagar cualquier cargo por cancelación o modificación en el que incurra. En casos excepcionales, algunos hoteles no permiten hacer cancelaciones o modificaciones a las reservaciones una vez que estas han sido realizadas, según se describe en las reglas y restricciones de la reservación del hotel. El AFILIADO acepta cumplir los términos y condiciones establecidos en relación con las reservaciones pre-pagadas del hotel en el que efectúa la reservación.
El AFILIADO podrá consultar que políticas de cancelación aplica para cada hotel, seleccionándolo y entrando a la liga denominada “Política de Cancelación”.
Para cancelación de reservaciones aéreas no existen reembolsos. Los cambios se efectúan directamente a través del Concierge de Viajes, mismos que quedan sujetos a cargos por cambios de tarifa y penalidades según las políticas de cada Aerolínea. Una vez expedidos los boletos aéreos a favor del AFILIADO. BEYOND no se responsabiliza por ningún cambio de itinerario, o por cualquier cambio o error en datos proporcionados por el AFILIADO para la emisión de boletos aéreos como puede ser el caso de nombres, apellidos, edades, sexo, fechas, rutas, líneas aéreas, clases, categorías, o cualquier otro proporcionado por el AFILIADO.
BEYOND no se responsabiliza por ningún cambio de itinerario, o por cualquier cambio o error en datos proporcionados por el AFILIADO como puede ser el caso de nombres, apellidos, edades, sexo, fechas, rutas, clases, categorías, o cualquier otro proporcionado por el AFILIADO. Esto aplica para las reservaciones en cruceros, transportación terrestre, renta de autos, paquetes, eventos, excursiones, tours, reservaciones en campos de golf, yates y servicios marinos, tickets y boletos. Todos los productos estarán sujetos a las políticas de cancelación de cada proveedor o prestador de servicios y productos.
Las marcas de BEYOND o las que se promocionan en el SITIO WEB, son marcas registradas o en proceso de registro para uso exclusivo de BEYOND, o de los PROVEEDORES o PRESTADORES, y de manera no limitativa todos los visibles dentro del SITIO WEB correspondiente a logotipos, nombres comerciales, patentes, modelos de utilidad.
El AFILIADO NO puede ni podrá en parte o en todo copiar, reproducir, grabar, publicar, enseñar, descargar, imprimir, modificar, alterar, trasmitir, distribuir o reproducir de ninguna forma, ni las marcas o el contenido del SITIO WEB, sin contar con la previa autorización expresa de BEYOND.
EL AFILIADO manifiesta reconocer y entender en forma no limitativa que todos los textos, párrafos, enunciados, elementos, colores, diseño, combinación específica de palabras, letras o elementos fonéticos, gráficos, iconos de botones, obras de diseño gráfico, fotografías, combinación específica de colores y formas, material editorial, formatos impresos, formatos de búsqueda, descargas digitales, compilaciones de datos, códigos fuente, software (s), programa (s) de computación, base (s) de dato (s), dentro del SITIO WEB, constituyen Derechos de Autor registrados o en proceso de registro y son propiedad exclusiva de BEYOND o de los PROVEEDORES y PRESTADORES, o sobre los cuales se cuenta con Contrato de Licencia de Uso y son parte del objeto del SITIO WEB, por tanto el AFILIADO NO puede ni podrá en parte o en todo copiar, reproducir, grabar, publicar, enseñar, descargar, imprimir, modificar, alterar, trasmitir, distribuir o reproducir de ninguna forma, los Derechos de Autor del SITIO WEB, sin contar con la previa autorización expresa de BEYOND.
Los títulos de las cláusulas del presente Contrato, son únicamente para facilitar su lectura y manejo, por lo que no se entenderá que definen o limitan las obligaciones a cargo de BEYOND o del AFILIADO.
En relación a los términos y condiciones tanto AFILIADO como BEYOND pactan que se regirán por la legislación Mexicana y en específico por los Tribunales y a la Jurisdicción del Estado de Quintana Roo, renunciando expresamente a cualquier otra jurisdicción que por domicilio actual o futuro que pudiera corresponderles.

The existing website is a platform administered by LA MEJOR Y MAS GRANDE EXPERIENCIA, S. de R.L. de C.V. (hereinafter ” BEYOND”), same that will be referred to as “WEBSITE”. The use of the WEBSITE is determined by the present Terms and Conditions, the same that we request and require the AFFILIATE to read thoroughly, since by visiting and using the WEBSITE or having reserved or contracted any service by phone or email with Beyond-Experience, the AFFILIATE is acknowledging to know, understand and to accept the current Terms and Conditions.
The WEBSITE has the purpose to facilitate the AFFILIATES with tips and travel information, and determining the availability of goods and services of tourism and recreational activities, events, air and terrestrial transportation, and to make and arrange legitimate reservations acting as an intermediary between the AFFILIATE and the SUPPLIERS. The term Beyond-Experience refers to the administrator of the Platform to which access is provided to the AFFILIATES of “BEYOND” or LA MEJOR Y MAS GRANDE EXPERIENCIA S. DE R.L. DE C.V.; a company constituted under the Mexican Legislation. The term “AFFILIATE” refers to every person or company who has signed or accepted the Terms and Conditions and has access to the WEBSITE and/or who makes a reservation through the WEBSITE or by phone or email.
For the present instrument, the following definitions will be understood, the words not considered in the present section, will be given the legal meaning or that of the general use:
BEYOND will be able to check as often and without prior notice to the AFFILIATE, any information that is transmitted or reproduced in this WEBSITE. BEYOND reserves the right to censure, eliminate, modify or prohibit whole or partially the information that in the opinion of BEYOND violates the conditions, safety, image or any other doing in opposition to the politics of BEYOND.
The AFFILIATE declares for his own and personal right, i) to be a legally able to acquire this affiliation, ii) to be at least 18 years of age, iii) to have the economic and financial capacity to acquire the affiliation and to abide by the present Terms and Conditions, iv) as well as to have a self-interest and willing to realizing searches and obtaining reservations across the WEBSITE, v) the AFFILIATE accepts BEYOND as intermediary and to understand and to accept that the SUPPLIERS own terms for service for each product or service
The AFFILIATE declares, i) to understand and to accept that to search and book and reserve through the WEBSITE and the AFFILIATE accepts these Terms and conditions.
THE AFFILIATE will be able to realize searches and reservations of the products and services that BEYOND promotes and commercializes in intermediary’s character through its WEBSITE.
BEYOND will grant previously to the AFFILIATE, a license of use of the search-engine for bookings and reservations in the WEBSITE, by the specific terms and conditions agreed by the AFFILIATE.
Every product and service inside the WEBSITE will contain the prices that will cost only during the quotation and until the same reservation has been completed. The reservations will be subject to availability, subject to the politics and conditions of the SUPPLIERS, and the prices or costs will be able to change according to the period of the year, country or various reasons. The changes and modifications to the reservations will be able at any moment to be subject to availability and changes of the tariff.
As soon as the reservation is confirmed, the AFFILIATE will have to print it and present it in the dates indicated to the SUPPLIERS to make the service valid.
BEYOND reserves the right to add or to modify the Terms and Conditions at any moment without a previous notification to the AFFILIATE. The terms and conditions, as well as its modifications,will be active and valid at the moment that are published. The AFFILIATE will be able at all times to check the Terms and Conditions using the WEBSITE www.www.beyond-experience.com
The AFFILIATE admits that BEYOND is a company which object is the rendering of a service as an intermediation as a Travel Agency via internet or call-center. BEYOND carries out as per requested, the reservations of the products and services promoted on the WEBSITE, between the AFFILIATE and the SUPPLIERS. BEYOND is not liable and will not assume any responsibility of the relation between AFFILIATE and SUPPLIERS of the products and services, for which, the AFFILIATE at the moment of booking and buying accepts and recognizes as is stipulated in these Terms and Conditions, and releases BEYOND of any responsibility for i) fails, ii) delays, iii) partial nonperformance, iv) entire nonperformance, v) charges on the products and/or services that SUPPLIERS are providing in a direct or indirect way via BEYOND.
The AFFILIATE will be able at all times and by a direct way or across other intermediaries to acquire equal or similar products or any other product or service from the same SUPPLIER, for which, BEYOND will not be responsible for the PRODUCTS and purchased SERVICES from the SUPPLIERS.
BEYOND neither offers nor guarantees lowest prices of products or services and that BEYOND publishes at all times the best tariffs; nevertheless, BEYOND will always look for the commercial alliances that offer benefits, discounts, packages, and any bonus to the AFFILIATE.
All the SUPPLIERS of the WEBSITE reserve the right to change at any moment the tariffs and costs, for what BEYOND reserves the right to cancel any reservation if the finished payment has not been carried out on the part of the AFFILIATE.
BEYOND will not be responsible for the charges or extra procurement that the AFFILIATE acquires straightly of the SUPPLIERS.
The SUPPLIERS will be able to request the AFFILIATE a disclaimer of liability to execute some services.
The AFFILIATE will have to read the features and cancellation policies of the product acquired through the WEBSITE. The AFFILIATE agrees to know and understand that all the reservations and bookings that it carries out through the WEBSITE are subject to additional terms and conditions, by what it is asked to read carefully, these terms and conditions themselves that have been determined on the part of the SUPPLIERS. The AFFILIATE grants to hold of the additional terms and conditions, on having realized, having carried out and having applied the reservation and/or purchase of the PRODUCTS or SERVICES, accepting to pay opportunely any debt, extra acquisition, as well as to abide by the politics and regulations established by the SUPPLIERS as regards the application of the reservation, availability, dates, and products or employed services.
A flight is confirmed, only and exclusively when the payment has been charged, and the AFFILIATE receives at the moment through the WEBSITE or by email, the confirmation tickets of the airline reservation.
The AFFILIATE is obliged when using services of air transportation to have a current passport, printed confirmation of the flight ticket, visa (when applicable), to check the safety politics, in addition to any other document that the airline has stipulated at the moment of the service.
For the policy of the SUPPLIERS, it may happen that at the time of making the product or service effective, the SUPPLIERS requests the AFFILIATE to leave a credit card or guarantees in cash for possible extra expenses. The deposits mentioned above and charges will be completely foreign and unrelated to BEYOND.
BEYOND does not advise to travel to any destination in particular, for which it does not guarantee it nor will guarantee that the trip to the above mentioned foreign destinations are sure or free of risks and will not be responsible for damages or losses derived for the trip to the same ones.
The AFFILIATE understands that the violation of any of the rules or previous restrictions can have, as a result, on the part of BEYOND and/or SUPPLIERS the cancellation of any reservation or bookings or access to the products or services hired, without the right to a refund.
THE AFFILIATE is, and will be at all times the only person in charge of guaranteeing with the legal requisites for the exit of its country, as well as of entry to foreign countries, therefore, the AFFILIATE will have to investigate for proper account the current legislation of the fatherland and that of the destination of the trip and proceed for personal account with the necessary documents like passports, visas, notarial permissions in case the minors travel without one or both parents, and in general any current legislation in the country of origin and destination.
THE WEBSITE tries at all times, to provide the AFFILIATE, the best prices, and tariffs; nonetheless, these prices and tariffs are not guaranteed and can change and suffer last minute changes that BEYOND cannot control.
BEYOND will not be liable under any circumstance for damages, injuries, loss, damage that results from the use of this WEBSITE or of the content that here is, for the flaw, delay or inability to use any component of this WEBSITE for the services of reservation and booking.
Neither BEYOND nor its Affiliates, will be responsible for any direct or indirect, punitive, incidental, compensatory, consequential damage that e-mails could provoke the electronic device of the AFFILIATE resulted from a virus for its WEBSITE, servers, or due to the access, use or navigation that does of this place, or for the discharge of any material, fact, text, image, video or audio in the WEBSITE. The emails and servers of BEYOND and its SUPPLIERS remain constantly protected from virus.
The information, content, and description, software, products and services that are published in this WEBSITE can contain errors or inaccuracies, including price errors. BEYOND does not guarantee with accuracy and does not assume any responsibility for the inaccuracies or errors related to the information, description of the products and services provided by the SUPPLIERS.
BEYOND will not be responsible for the severe climate in the dates that the reservation of the AFFILIATE is applicable; the AFFILIATE will not be able to request a refund from BEYOND.
BEYOND reserves the right of correction of prices and content inside the WEBSITE or directly in the reservations that have been achieved with inaccurate prices, being able at all times BEYOND to request the correct payment or to cancel without penalization the reservation of the AFFILIATE.
The ratings of the hotels promoted inside the WEBSITE have the purpose to provide a general parameter to the AFFILIATE of the conditions, characteristics and quality of the service. BEYOND does not guarantee me) the accuracy of the rating of the hotel products, ii) products or services that could be found about the product chosen, iii) particular products or services that can be obtained inside the product or chosen hotel.
BEYOND does not have nor will have any labor relationship with the SUPPLIERS or with third hired by the same individuals, for what BEYOND will not be responsible for the acts or omissions which the SUPPLIERS mentioned above incur or third-party ones that they have hired to grant the product or to give the service.
BEYOND will not be responsible, and it will not provide any refund owing to delays, cancellations, overbooking, strike, fortuitous case, force majeure or any other cause out of its direct control, as well as it does not have neither it will have some responsibility related to any additional expense, omission, delay, changes of route or acts of any authority or government, as well as of the legal dispositions or its modifications in the countries where the product is granted or the service leads.
In the fortuitous case or of Force Majeure, BEYOND will be able to suspend the service of its services, until the event that causes the cause has happened and yielded completely. BEYOND will guarantee only and exclusively the products and services that the AFFILIATE has reserved bought and completely paid for, only before the event happens of fortuitous case or force majeure.
BEYOND will be able to yield or delegate partly or in its entirety each or all the rights and obligations of this contract without previous notice or need for assent on the part of the AFFILIATE. BEYOND assumes no obligation and compromises to guarantee the service of the services of intermediation in the case of transfer or delegate partly or entirely of its obligations.
The AFFILIATE will not be able to yield, subcontract, delegate rights or obligations here contracted. The AFFILIATE will not be able under any concept to commercialize or use this WEBSITE with commercial ends or gains.
All the cancellations will have the following process: i) the AFFILIATE will have to call BEYOND expressing the desire to cancel the service previously contracted; BEYOND will assign a travel Concierge and an email address for follow up, ii) the AFFILIATE will have to send an email to the Concierge assigned by BEYOND specifying the date of purchase and the reservation or confirmation number.
The AFFILIATE will be able to cancel or change its hotel reservations for which the full payment has been made. BEYOND does not take responsibility for any change of itinerary, or for any change or error in the information provided by AFFILIATE for the reservation of the accommodations as it can be the case of names, surnames, ages, sex, dates, routes, airlines, classes, categories, or any other provided by the AFFILIATE.
Every cancellation or change will be subject to the politics of cancellation or change of the hotel. If the AFFILIATE does not cancel or changes its reservation before the applicable period of the politics of cancellation of the hotel that it reserved, which changes in every hotel, will be subject to a charge of the applicable tariff per night, the charges for recovery of taxes and service fees. In the case the AFFILIATE does not show the first night of the reservation,and plans to register for the next nights, the AFFILIATE must communicate and confirm the reservation changes with the travel Concierge not later than the date prior to the reservation of the first night to avoid the cancellation of its reservation in total.
The AFFILIATE accepts to pay any charge for cancellation or modification in which he or she incurred. In exceptional cases, some hotels do not allow cancellations or amendments to the reservations once these have been realized, as it is described in the rules and restrictions and cancellation policies of each hotel reservation. AFFILIATE accepts to fulfill the terms and conditions established as regards the reservations prepaid to the hotel in which he or she carries out the reservation.
The AFFILIATE will be able to consult the cancellation policies for every hotel, select the link at Cancellation Policies.
For cancellation of FLIGHT reservations, refunds do not exist. The changes are carried out straight through the travel Concierge; these remain subject to charges for any changes in the tariff and hardships as detailed in the policies of every airline. Once the airline tickets have been sent to the AFFILIATE, BEYOND does not take responsibility for any change of itinerary, or for any change or error in the information provided by the AFFILIATE for the issue of the airline tickets as it can be the case of names, surnames, ages, sex, dates, routes, airlines, classes, categories, or any other information provided by the AFFILIATE.
The Trademarks of BEYOND or those in the WEBSITE are registered trademarks or in pending registration and are for the use of BEYOND, or of the SUPPLIERS, and in a not limitation way all the visible ones inside the WEBSITE corresponding to logotypes, trade, clear names, and models of profit.
The AFFILIATE cannot be able to partly or in its totality to copy, reproduce, record, publish, teach, discharge, print, modify, alter, transmit, distribute or reproduce neither in form, nor the trademarks nor the content of the WEBSITE, without being provided with the express written permission of BEYOND.
THE AFFILIATE accepts to recognize and to understand in a not imitative way that all the texts, paragraphs, statements, elements, colors, design, the specific combination of words, bills of exchange o phonetic, graphic elements, icons of buttons, works of graphic design, photos, particular combination of colors and forms, publishing material, printed formats, formats of search, digital discharges, compilations of information, source codes, software (s), the programs (s) of computing, databases, inside the WEBSITE, constitutes a registered copyright or in process as apending copyright and is the exclusive property of BEYONDor the PROVIDERS and SUPPLIERS, or the ones that are provided with Contract of License of Use and there are a part of the Object of the WEBSITE, therefore, the AFFILIATE cannot be able partly or totally to copy, reproduce, to record, publish, teach, discharge, print, modify, alter, transmit, distribute or reproduce of no form, the copyright of the WEBSITE, without being provided with the express previous authorization of BEYOND.
The titles of the clauses of the present Contract, are only to facilitate its reading and handling, by which they will not be understood to define or limit the obligations of BEYOND or the AFFILIATE.
As regards, the terms and conditions both AFFILIATE and BEYOND agree that they will be ruled by the Mexican Laws and in particular by the Courts and to the Jurisdiction of the State of Quintana Roo, resigning definitely from any other jurisdiction that for current or future address could correspond to them.
